What is the relationship between health foods and the Pharmaceuticals and Medical Devices Act (formerly the Pharmaceutical Affairs Act)?
As mentioned in the previous article, the Pharmaceuticals and Medical Devices Act covers pharmaceuticals, quasi-drugs, cosmetics, medical devices, and regenerative medicine products. Health foods do not fall under any of these categories, and are not directly subject to regulation by the Pharmaceuticals and Medical Devices Act. However, if a product falls within the scope of the Pharmaceuticals and Medical Devices Act, such as claiming to have the same efficacy or effect as a pharmaceutical or using ingredients that are only used in pharmaceuticals, it will be subject to regulation, so consideration of the Pharmaceuticals and Medical Devices Act is still required.
